AGENCY PROPERTIES. IMPORTANT - Proceed with care. We suggest you do not immediately click on the agency sales link to the right. You can save yourself huge expense by spending a few minutes reading the articles, Strategy on Costs, at the bottom of this page before enquiring about agency properties. You can then browse 1000s of properties and know you are in full control of your costs, saving in some cases as much as will furnish the home. Recently we were able to save a client over €40,000 of commissions on a Spanish property.
BUYERS and SELLERS. (1) Be aware that the general rule is that an agent is entitled to his/her commission if he/she is first to introduce a buyer to a property. However, some agents will go further than this and, because you have made contact with them, apply this rule to property they may yet show you at some time in the future. If you contact agencies directly, this is how you can lose cost-saving benefits and leave us powerless to do anything about it. When you need more information about properties directly from agents, remain incognito; better still, ask us to make the enquiries for you.
(2) If you are buying from an owner selling privately but the owner has given an agent exclusive rights, the agent can claim full commission even if the owner or someone else sells the property.
You might wonder how this affects you as a buyer. In Spain, commission at 7½% included in with the price of the house means the buyer ends up paying it; exclusive rights could kill a potential sale. Obviously, if exclusive rights did not apply, the owner could afford to reduce the price by the amount of that commission with no loss to that owner.
And for the seller: It is not uncommon for the agent selling the property and the agent with exclusive rights to be different people and both claiming commission. This again could jeopardise a potential sale. It is best to get exclusive rights removed. At least give the subject serious thought before you give any agent exclusive rights.
Cashback with agency property. This can be substantial and, unlike with private sales, it is essential that we make the introductions before you contact the agent.
Cashback and preferential terms with professional people. These are always dependent upon the introductions being made by us initially.
